Terms of Service
These terms govern every placement bought on SpotBoard. Buying a placement means you accept them. They sit alongside the Rules of the Board and the Privacy Policy, which form part of this agreement. Where the Rules describe what may be advertised, these terms describe the contract to advertise it.
01. Who You Are Contracting With
SpotBoard is operated by https://x.com/amritmalla9 (“we”, “us”), which sells and runs the placements described here. Payments are processed by Dodo Payments Inc., which acts as Merchant of Record and is the seller of record for the transaction. Dodo handles billing, tax and VAT/GST compliance, and its own terms apply to the payment itself. Everything to do with the placement — what runs, for how long, and whether it stays up — is governed by this agreement with us.
02. Eligibility
You must be at least 18 and able to enter a binding contract. If you are buying on behalf of an organisation, you confirm you are authorised to bind it. You must be entitled to advertise the destination you submit — you either own it or have the owner’s permission.
03. What You Are Buying
SpotBoard sells 16 product spots with live pricing. A spot’s price starts at its opening rate and drops on a fixed schedule until someone claims it or it reaches its floor. There is no bidding and no negotiation; the first completed checkout takes the spot.
Starting checkout locks the displayed price and holds the spot for 3 minutes. If payment is not completed in that window the hold lapses and the spot returns to the board at whatever price the price has reached — which may be lower than the one you were quoted.
A confirmed placement runs for 168 hours from activation. You are buying that period of display on the board and nothing else.
Where the price reaches $0 the placement may be claimed at no charge. The same destination may claim a free placement once every 3 days.
04. What We Do Not Promise
We do not sell traffic. You are buying time on the board, not a number of impressions or clicks. Historical figures shown beside a spot are medians of what past placements recorded there. They are history, not a forecast, and no level of performance is promised or refundable.
We do not promise uninterrupted availability. SpotBoard may be unreachable for maintenance, provider outages, or causes outside our control. Where an outage materially consumes a placement we will extend it or refund it at our discretion; brief interruptions do not entitle you to either.
05. Your Content and Your Destination
You are responsible for the destination URL, the title, the description, and any imagery drawn from your site. You confirm that they are lawful, accurate, not misleading, do not infringe anyone’s rights, and do not breach section 03 of the Rules.
That responsibility runs for the whole placement, not only at checkout. If your destination changes after purchase into something the Rules prohibit, the placement may be removed under section 06.
You grant us a non-exclusive, royalty-free licence to display that material on the board for the duration of the placement, and to keep the public stats page afterwards. Product stats pages are permanent and public. The listing page at /l/[slug] and the entries in the public stats remain after the placement ends; they are the record that makes the board’s published numbers checkable, and they are not removed on request.
06. Screening, Review and Removal
Every destination is screened automatically before publication. Listings that breach the prohibited-content rules are refused at checkout and no payment is taken. Listings carrying signals we associate with phishing, malware or impersonation go live and are queued for manual review, as set out in section 04 of the Rules.
We may remove a live placement. If review finds it breaches the Rules, misrepresents itself, or has materially changed since purchase, we terminate it and permanently block the URL. Removal for a rules breach is without refund. If we remove a placement in error, we refund it in full.
Screening is a filter, not a warranty. We do not endorse advertised products, and we do not publish the heuristics that trigger review.
07. Payment, Refunds and Taxes
Prices are shown in US dollars. Dodo Payments, as Merchant of Record, collects and remits applicable taxes; the amount you are charged may therefore differ from the displayed price by the tax due in your location.
Because inventory is scarce and placements activate immediately, all payments are final. The only exception is a placement we remove in error under section 06. Raising a chargeback instead of contacting us may result in the placement being terminated and the destination blocked.
08. Measurement
Clicks are counted as described in section 06 of the Rules: through our edge redirect, with bot and duplicate filtering. We do not measure viewability and make no claim about it. Our records are the authoritative measure for anything in this agreement. Measurement is best-effort and deliberately conservative — it will undercount rather than inflate — and nothing you are charged depends on it.
09. Public Product Stats
Checkout provides a permanent public URL for your product’s SpotBoard record. It shows placement history, prices paid, and delivered clicks. There is no account, password, or private stats token: anyone can view these figures.
10. Acceptable Use of the Service
You must not interfere with pricing or the measurement that supports it. That includes automating purchases to corner inventory, generating artificial impressions or clicks on any placement, probing or circumventing screening, and scraping the board beyond the published rate limits. We may suspend access and terminate placements for any of these, without refund.
11. Disclaimers and Limitation of Liability
SpotBoard is provided “as is”. To the extent the law allows, we exclude all implied warranties, including fitness for a particular purpose and any warranty as to advertising results.
To the extent the law allows, our total liability arising from a placement is limited to the amount you paid for that placement. We are not liable for lost profits, lost revenue, lost business, or indirect or consequential loss. Nothing here excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by negligence.
12. Indemnity
You will indemnify us against claims, losses and reasonable costs arising from the content you submitted, the destination you advertised, or your breach of these terms.
13. Changes to These Terms
We may revise these terms. The version published when you buy is the version that governs that placement; revisions apply to placements bought after they are posted. The revision date is shown at the foot of this page.
14. Governing Law
These terms are governed by the laws of Nepal, and its courts have exclusive jurisdiction over any dispute arising from them.
15. Contact
Questions about a placement, a removal, or these terms go to spotboard3@gmail.com. Billing and payment queries are handled by Dodo Payments, reachable from your receipt.
Public support is also available on X at @amritmalla9. Anything sent there is public — do not post payment details or your checkout confirmation URL. The product stats URL itself is intentionally public.
